1. Acceptance of terms
These Terms of Service ("Terms") are an agreement between you and On Dot Property Agent ("we", "us", or "our"). By accessing or using ondotproperty.com or our related services (collectively, the "Services"), you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Services. You must be at least 18 years old and legally capable of entering a binding agreement to submit a property, make a transaction-related inquiry, or use the Services on behalf of another person or organisation.
2. Our role and services
On Dot Property Agent provides property discovery, advertising, inquiry, and facilitation services for rentals, resales, and new projects. We may help users connect with owners, developers, brokers, tenants, buyers, or other property-market participants.
Unless expressly agreed in writing, we are not a party to any sale, lease, licence, booking, loan, or other transaction between users and third parties. We do not provide legal, tax, financial, engineering, or investment advice.
3. Property information and verification
We aim to present useful and current property information, but listings may be supplied by owners, developers, brokers, public sources, or other third parties. Prices, availability, areas, amenities, approvals, possession dates, photographs, and other details may change or contain errors.
Labels such as verified, featured, or similar wording describe checks performed at a point in time and are not a guarantee of title, condition, legality, availability, developer performance, or transaction outcome. You must independently inspect the property and verify all material facts and documents before making a decision.
Never transfer funds or sign documents solely in reliance on a website listing. Obtain appropriate professional advice and verify the identity and authority of the counterparty.
4. Your responsibilities
- Provide accurate, current, and complete information and update it when circumstances change.
- Submit or publish property information only when you have the legal right and authority to do so.
- Ensure that photographs, descriptions, floor plans, trademarks, and other submitted material do not infringe another person's rights.
- Use contact details and inquiries only for genuine property-related purposes and respect the privacy and preferences of others.
- Carry out independent legal, technical, financial, title, regulatory, and physical due diligence before any transaction.
- Comply with applicable law, housing rules, society requirements, developer terms, and contractual obligations.
5. Content you provide
You retain ownership of content you submit. You grant On Dot Property Agent a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, publish, display, distribute, and promote that content for operating and marketing the Services and the relevant property listing.
You confirm that your content is lawful, accurate to the best of your knowledge, and does not violate privacy, confidentiality, intellectual-property, contractual, or other rights. We may edit formatting, reject, suspend, or remove content that is inaccurate, unlawful, expired, duplicated, misleading, or inconsistent with these Terms.
6. Acceptable use
You may use the Services only for lawful, genuine property-related purposes. You must not:
- Post false, deceptive, discriminatory, unlawful, unauthorised, or fraudulent content.
- Impersonate another person, misrepresent your authority, or conceal material facts about a property or transaction.
- Scrape, harvest, copy, republish, or commercially exploit listings or personal information without written permission.
- Interfere with website operation, bypass security, introduce malicious code, probe vulnerabilities, or overload the Services.
- Send spam, unsolicited promotions, abusive messages, or use contact information for unrelated purposes.
- Use the Services in a way that infringes rights, violates law, or exposes On Dot Property Agent or another person to harm or liability.
7. Third-party services
The Services may contain links to or integrations with Google Maps, WhatsApp, Formspree, social networks, developer websites, payment or finance providers, and other third parties. We do not control their availability, content, security, or practices. Your dealings with them are governed by their own terms.
Any discussions, inspections, negotiations, payments, agreements, or disputes with an owner, developer, broker, buyer, tenant, lender, service provider, or other third party are between you and that party.
8. Our intellectual property
The On Dot Property Agent website, software, design, branding, logos, text, graphics, and other original materials are owned by or licensed to On Dot Property Agent and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the Services for their intended purpose. No other rights are granted.
9. Availability and changes
We may change, suspend, restrict, or discontinue any part of the Services or remove a listing at any time. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free, or that every inquiry will receive a response or result in a transaction.
10. Disclaimers and liability
To the maximum extent permitted by law, the Services and all property information are provided on an "as is" and "as available" basis without warranties of any kind. We disclaim implied warranties including accuracy, merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by law, On Dot Property Agent and its personnel will not be liable for indirect, incidental, special, punitive, or consequential loss, or for loss arising from a third-party transaction, property decision, inaccurate listing, interruption, unauthorised access, or reliance on the Services. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Indemnity
You agree to indemnify and hold harmless On Dot Property Agent and its personnel from claims, losses, liabilities, and reasonable costs arising from your content, your misuse of the Services, your transaction or dealings with another party, your breach of these Terms, or your violation of law or another person's rights.
12. Suspension and termination
We may restrict or end your access, remove content, or stop handling an inquiry if we reasonably believe these Terms have been breached, the activity is unlawful or harmful, or action is required to protect users or the Services. Provisions that by their nature should survive termination will continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of India. Subject to applicable law, courts in Thane, Maharashtra will have jurisdiction over disputes arising from these Terms or the Services. Before starting formal proceedings, the parties should attempt in good faith to resolve the matter through written notice and discussion.
14. General terms
If a provision is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms and the Privacy Policy form the entire agreement about your use of the Services, unless a separate written agreement applies.
We may update these Terms by posting a revised version and changing the "Last updated" date. Continued use after an update means you accept the revised Terms.
